Distance Sales Agreement

This agreement has been prepared in accordance with the Regulation on the Procedures and Principles of Implementation of Distance Contracts published in the Official Gazette dated 27.11.2014 and numbered 29188, which requires contracts for sales carried out over the internet. The articles are as follows:

Article 1 – Subject

The subject of this agreement covers the rights and obligations of the parties regarding the sale and delivery of the product, whose characteristics and sales price are specified below, in accordance with the provisions of the Law on Consumer Protection No. 4077 and the Regulation on the Implementation of Distance Contracts.

Article 4 – Product Information

The type, quantity, brand/model, color, number, sales price, payment method, and details at the time of order confirmation constitute the product information.

Article 5 – General Provisions

  • The consumer declares that they have read and acknowledged all preliminary information regarding the product(s), including basic characteristics, sales price, payment method, and delivery, and have given the necessary electronic confirmation.

  • The product(s) shall be delivered within the legal period of 30 days, depending on the consumer’s location, and may be extended up to 10 days with prior notice.

  • If delivery is to another person or institution, Ixir Shifa cannot be held responsible if they refuse acceptance.

  • Ixir Shifa is responsible for delivering the product(s) intact, complete, in accordance with the order specifications, and with warranty certificates and user manuals if applicable.

  • Delivery is conditional upon receipt of the signed contract and payment. If payment is not made or canceled by the bank, Ixir Shifa is released from delivery obligations.

  • In cases of unauthorized use of the consumer’s credit card after delivery, the product must be returned within 3 days, with shipping costs borne by the consumer.

  • In extraordinary circumstances (force majeure, adverse weather, transportation disruptions), Ixir Shifa must inform the consumer, who may then cancel, request replacement, or accept delayed delivery. Refunds are made within 15 business days if canceled.

  • Faulty or defective products may be returned for repair under warranty, with shipping costs covered by Ixir Shifa.

  • This agreement becomes valid once signed and delivered to Ixir Shifa or electronically approved on the website.

  • Prices include VAT but exclude shipping. Promotional campaigns are subject to terms.

Article 6 – Right of Withdrawal

The consumer has the right to withdraw within 14 days of delivery. Notification must be made via fax, e-mail, or phone, and the product must be unused. The original invoice and delivery note must be returned. Refunds are made within 15 days.

Products that cannot be returned:

  • Single-use items, software, programs, perishable goods, expired goods.

  • Products customized or altered for the consumer.

  • Outlet products with less than one year of shelf life.

If payment was made by credit card, the consumer may request cancellation in case of unauthorized use, and the issuing bank must refund within 15 business days.

Disputes are subject to Consumer Arbitration Committees and Consumer Courts at Ixir Shifa’s location.

Article 7 – Shipment and Delivery

  • Orders are shipped upon confirmation via e-mail.

  • Delivery is made to the specified address as soon as possible via contracted courier.

  • Ixir Shifa is not responsible for delays due to incorrect information, absence of the consumer, or refusal of delivery by third parties.

  • Damaged packages must not be accepted; a report must be filed with the courier. If accepted, responsibility lies with the consumer.

Article 8 – Privacy Policy

  • Personal information (name, birth date, address, phone, e-mail) is considered confidential.

  • Ixir Shifa may use personal data for profiling, statistics, advertising, promotion, and marketing.

  • Ixir Shifa undertakes to keep personal data confidential and secure, but is not liable for breaches due to cyberattacks.

  • Cookies may be used; consumers can adjust browser settings to block them.

  • Consumers may update their personal information and preferences at any time.

  • Promotional e-mails can be unsubscribed via account settings.

  • By visiting the website, users are deemed to have accepted this Privacy Policy.

Article 9 – Jurisdiction

In case of disputes arising from this agreement, the courts at Ixir Shifa’s location are authorized.
